General Terms and Conditions (GTC) for Sculpture Lifestyle GmbH

These General Terms and Conditions (GTC) apply to all services, memberships, and products of Sculpture Lifestyle GmbH, Im Rosental 6, 61231 Bad Nauheim. By using our website and booking courses or purchasing memberships via
www.sculpture-pilates.com, you accept the following conditions.
1. Subject of the Agreement
These GTC govern the contractual relationship between Sculpture Lifestyle GmbH (hereinafter "Sculpture") and the participants (hereinafter "Participants") regarding participation in fitness courses, memberships, and the use of facilities and services.
2. Registration and Course Booking
2.1. Registration and course booking are made via our website www.sculpture-pilates.com, our app, or on-site. Participation in the courses is only possible after successful booking and payment.
2.2. Places in the courses are limited and allocated on a "First Come, First Serve" basis. Participants must wear appropriate sports clothing and grip socks to attend the courses.
2.3. For certain events or offers such as the "Invite Only Week," booking is only possible with special codes.
3. Prices and Payment Terms
3.1. The current prices for courses, memberships, and other services can be viewed on www.sculpture-pilates.com. All prices include statutory VAT.
3.2. Payment is made via the payment methods offered on our website or on-site. Sculpture reserves the right to change prices. Changes will be announced on the website.
4. Credits and Membership Packages
4.1. Credits can be used for all courses. Participants can choose from various packages that offer discounts depending on the number of credits purchased. Credits are non-transferable and have a set validity period.
4.2. Unused credits within the validity period will expire and cannot be refunded.
5. Cancellation and Rebooking
5.1. Cancellations must be made at least 12 hours before the start of the course; otherwise, the credit is forfeited, and no refund or rebooking is possible.
5.2. In case of illness or unforeseen events, a rebooking can be requested with a medical certificate.
5.3. For special events or promotions, different cancellation deadlines may apply.
6. Use of Facilities and Equipment
6.1. Participants have access to changing rooms and lockers during their course times. Sculpture provides premium equipment and care products.
6.2. In our studio, we offer nutritional products like juices and protein shakes, which can be ordered before the training and picked up after the course.
7. Liability
7.1. Sculpture is not liable for injuries caused by improper use of fitness equipment or disregard of the trainer’s instructions.
7.2. Participants train at their own risk. Participants are obliged to disclose any health restrictions.
7.3. Sculpture is not liable for the loss or damage of personal belongings unless gross negligence or intent is involved.
8. Studio Conduct
8.1. Participants are required to follow the house rules and the instructions of the trainers. In case of repeated misconduct, Sculpture reserves the right to exclude participants from training.
8.2. Bringing alcohol or illegal substances into the premises is prohibited.
9. Data Protection
9.1. Sculpture processes personal data in accordance with the General Data Protection Regulation (GDPR). Further information can be found in our privacy policy on www.sculpture-pilates.com.
9.2. Participants agree to the processing of their data for the performance of the contract. Data will only be shared with third parties if necessary for contract fulfillment.
10. Changes to the GTC
10.1. Sculpture reserves the right to change these GTC at any time. Changes will be published on the website and take effect immediately.
10.2. Participants who do not agree with the amended GTC have the right to terminate their membership.
11. Final Provisions
11.1. If any provision of these GTC is invalid, the validity of the remaining provisions shall not be affected.
11.2. The place of jurisdiction is Friedberg.
